But that was the recent reality at a metro Atlanta health IT company that had an unexpected visit from the FDA. The company quickly found out that a relatively new FDA ruling has far-reaching implications that were not initially apparent when the rule was published.
On February 15, 2011, the FDA published its final ruling on Medical Device Data Systems (MDDS), moving them from Class III to Class I. The new MDDS rule brings certain software products, which otherwise would not qualify as medical devices, under the FDA's regulatory purview if they store, transfer, display or convert electronic data obtained from a medical device.
